FAO ANYONE who has ever had a bank charge

Hi. i have not read through all this thread sowwie :oops:

i have never had a bank charge. but i have gone over a bit and just checked my statment it says UNAUTHORISED OVERDRAFT CHARGE £25

my bank at the mo is -£45 :oops:

but i get paid tonmorrow so i take it that £25 will get taken from my wage :twisted:

is that right? or should they not take it from me?
 
They shouldn't take it from you and you can get it back.

Also...be careful, most of them charge £25 A DAY when you go overdrawn.

If its on your statement it should have already come out, thats probably contributed to you being £45 overdrawn.

Do you get charged like this alot? If you do then add it all up and claim it back :)

no first time its ever happened. what happened was i paid my electric bill twice by mistake at the time i didnt have the money in my account.

tomorrow i get paid so i take it that -£45 will come out my money.
 
If you are in a hurry and it's only one charge I would print off some stuff from
www.consumeractiongroup.com take it into your branch and go fricking mad at them.

I bet they'll just put it straight back in, they've done that for me before.

what page should i print off? i dont have a printer but could forward it to kris at work he can bring it home then i go down tomorrow and say............????

Yes, say you got paid £150, you will only have £105 in your account, cos you "borrowed" £45 of the banks money when you went over.
 
if i called alliance and leicter now. do you think i could get it sorted over the phone??? cant being doing with the money being taken from me tomorrow :(
 
They will only give you back the £25, the other £20 would be your money you have already spent on paying the electric bill twice.

By all means ring them...A&L have paid more back in bank charges than any other bank.

Let’s be technical for a moment. The core rule is if there’s a breach of contact under English or Scottish law, any charge should not exceed the cost of the breach. In other words, banks can only impose charges which are in proportion to their costs.

Yet when you go beyond your overdraft limit, or have a cheque or direct debit payment bounce, the bank charges a penalty of £30 to £35 a time. Is a charge of this scale really proportionate? Remember it could simply be a charge for going a penny over the limit.
Importantly, the bank is actually fining you for going over the limit, and this fine is too high, hence under the law of penalties this is ‘extravagant’. After all, it simply sends a computer-generated automatic letter with a franked stamp. In fact a recent report by BBC2's The Money Programme, got a group of former senior bank staff together and they estimated the real cost, even being generous to be only somewhere between £2.50 and £4.50.

When you look at all this together, bank charges are unlawful, and that means the bank did not have a right to take your money. Yet it did, and it did it automatically, thus you are entitled to get your cash back.

Isn’t it in the terms and conditions though?

Of course when you got the bank account there were terms and conditions (though most don’t read them). Yet that’s irrelevant; a contract must be written within the law, and they can’t enforce a contract with legally unfair terms. Ultimately if it isn't proportionate then it's unlawful, and thus you've a right to your money back. Let me use my favourite analogy for this:
 
Im with Alliance and Leicester and I got nowhere with them on the phone. They had me so frustrated I was in tears. In the end it all had to be done by letters and eventually a court claim but it worked.

I know its not fair having to wait but at the end of it you're almost guaranteed to get whatever you're owed back.
 
Just a week after giving me all my money back the bank have decided to charge me another £25.

Apparently I've been overdrawn again but I havent as nothing has come out of my bank :shock:

Do I ring them and just say look, I suggest you stop the charge as I'll just claim it back again or do I let them take it and then just repeat the whole get-your-money-back process?
 
Give them a call and ask them what the charge relates to?! :wall: Tell them you have not used the account, and you cannot see why a charge has been made!

I rang up and argued on the phone and the woman was so rude, she just said if I had a problem with it to ring the banking ombudsman and then she hung up :shock:

I rang back and tried to explain things and a different woman put me on hold, said 'I've looked at your notes and Im cancelling the charge'.

She didnt even let me speak, she just said the charge wont come out after all.

It'll still come out, I know it will cos I've been through all this with them before. Every morning all I do is ring that fuc**ng bank and try and sort out the mess that they've got me into :x
 
How rude of that first woman!!! My first claim was A&L I got a mardy woman too.....think they must be trained to be rude!!

Hopefully they won't take the charge off you now........always best to ring back and hope for someone more helpful on the second attempt....especially as you don't want the hassle of going through letters etc for one charge!!
 
I have just seen this on GMTV and downloaded loads of info and letter templates from their site.

I have just written a letter to barclays to get my statement as my internet banking will now only go back to november last year! Stupid as i've had internet banking for years, i think they do it on purpose.

Anyway i went to college 2 yrs ago for 2 years and was well bad financially and most moths had 3 x £30 charges for going beyond my overdraft.

Now i am better and have paid of my overdraft so i am hoping to get some money back. What do you think my chances are?

I need the money so bad with babycoming and all!

You'll get your money back.....but you must stick to your guns. I had to start a court claim before I got a cheque back (so did my DF), so you'll prob have to do the same........you add the charge of the court cost to the money claim so you'll get that back too......

....it'll take maybe 6-8 weeks I would think, by the time the letters have gone forward and back etc.

Keep us updated with how you get on.

I claimed back from A&L last year, and have sent a letter off at the start of this week (finally) for my Lloyds accounts :cheer:
 
Great thanks i am sending my first letter today.

I'm sure they will be awkward so i will let you know what they say. I reckon it'll be over a grand at least! I was always getting charged at college.

Is it difficult to start up a court claim?

I had to start a court claim too and I thought it sounded like too much hassle but it was honestly so easy as I did it all online at http://www.moneyclaim.gov.uk.

It took about 2 weeks from sending my first letter to getting the money back.

The girls on here gave some really good info on how to word the court claim form and stuff, couldnt of done it without them :)

You'll definitely get your money back 8)
