I'm still confused. HSBC charged FIL £200 this week for going over drawn by £50!!! But he's had his account for like 20yrs, so maybe the bank can get away with this because his contract with them is so old? He's closing the account soon so i need him to sort this out NOW. So you think he could claim it back?

the bank cannot charge ANYONE legally more than the statutory amount of £12 per item, this is the limit set by the financial ombudsman

id recommend him claiming yes as im 99% sure he will be successful in gettting his money back :cheer:

the terms and conditions have nothing whatsoever to do with it, the bank is illegally breaking the law by charging these amounts, and because nobody challenged it for so long theyve got away with it, most banks are realising that theyre fighting a losing battle so changing their charges to be within the legal limit

Ive had at least £60 worth of charges a month for nearly 3 years now, so i could claim back a nice lil bundle! Im scared of doing it incase i loose and they charge me or something!! Plus i dont want to close my accounts there, i have 4 lol! One includes Jaycees trust fund
Can someone help me? :oops:
 
Wow thanks for this. Barclays are such a con. I've gone over by £7 and gonna get charged £30 so gonna be fecked next week. This used to happen to me once or twice a month and this time it's only because of the interest of £13 they've charged me for using the overdraft. Certainly seems worth paying a tenner to try to get that money back!
 
My banks still trying to f**k me over...I rang up yesterday and was told a £250 overdraft will be on my account today and she hasnt even put it on so I rang up and another woman said 'Oh it looks like she forgot to put it on' so now I have to wait another day before I've got any money :shock:

Is anyone actually happy with their bank cos Im definitely changing :evil:
 
If I could afford to pay them off my overdraft I'd soon move. I've been with Barclays since I were 15 and they're crap. My overdraft is £1,750 though, no way I'll be able to pay that off.
 
Any ideas if this would also work with a Building Society? (e.g Mortgage payments)charged £25 per letter sent?

Had loads of crap and charges when going through Divorce, this is a great thread, thankyou :hug:

Yes you can also claim back your money from building societies etc :)

send the letter to your local branch, theyll forward it to the relevant department

i was claiming for £1485 from a 2yr period, think of how many charges that was :shock:

and you will NEVER lose so dont worry about that, they arent likely to close your account, barclays didnt with me, neither did they take my overdraft off me or ask me to repay my loan, dont forget its the bank who is in the wrong not you :wave:

it works with any account, bank account or building society, or credit card, check on the consumer action site to check though, its worth the hassle believe me :cheer:
 
I think they only closed my account cos I was overdrawn, if you're not overdrawn then they don't close your account - DF was overdrawn, but by the time they paid back all his charges (direct onto the account) he was in credit so he still has his account with them to this very day!

Also, that money guy from GMTV says you can claim back for old accounts that are now closed - they will just need to pay you by cheque :cheer:
 
someone told me today they can only actually charge you 2.50 not 12.00 still ill go with the 12.00 either way im getting quite alot back
 
If you take them to court hun, they don't pay back at £30 or whatever minus the £12.00 they are allowed to charge - they pay back the full charges!!! Well, thats what they did for me & DF.

GOOD LUCK I hope it gets resolved quite quickly - then you can go on a shopping spree and treat yourself :cheer:

i took the full amount of refunded charges they gave me straight out, so i was back upto the total amount of my overdraft - £300 - and they didnt do anything to me or remove my overdraft facility
 
Thats good - I was with A&L and they closed my account straight away...sent the letter confirming it was closed when they sent the cheque - maybe each bank has different procedures for that bit?

Worth opening a second account in case.....I already had an account with lloyds so I just use that now.

yeah maybe, though i personally think A&L are one of the worst banks on the high st, from the account i had a few yrs back, they dont honour the account they say they will and then rape you for going so much as £2 overdrawn :wall:

i am curently trying this for my mum claiming £1000 in charges in last 6 years. :oops: .

Had letter from Abbey to sya they received first letter and will get back to us within 40 days? Do you think this is too long?

Also i went overdrawn tuesday , so wednesday they charged me £30 , i was not willign to pay £30 only £12 which they can charge, so i phoned Barclays Wednesday and had big argument stuck to what i wanted and got the whole £30 refunded back to em Goodwill they say lol

They are awful - most of the charges I got came around because I was transferring my account from lloyds to them, I signed everything for them to move my DD's & SO's & balance so that they would pay out of my new account without me having to contact everyone, and they transferred all the payment instructions - but not my balance?!?!?!? Then charged me when there wasn't anymoney in there to cover the DD's etc?!?! :shock:

As they never transferred my balance my Lloyds account stayed open so I just called them and asked them to keep it open.....I got so pee'd off with A&L refusing to refund the charges that I only got charged because of their incompetence - that what made me look into what we're discussing here - got it all paid back!!

I hate all banks really though, they're fair weather friends :shakehead:
