Would I get if I was being subpoenaed for court? My boss phoned today and asked if u could go to court as a witness in Friday. I'd already told them few weeks ago that I can't. LO is refusing bottles and therefore needs me to feed him. Told boss all this and said he was only the message carrier but they mite subpoena me. This case was thrown out of court in September and the silly woman has now gone to high court. She fell on ice and sprained her wrist. I'm the only receptionist she spoke to but even at that my evidence isn't vital to the case. I can't b away from jack from 8am-4pm. Right now I'm feeling harassed. I'm off on maternity leave and don't need silly days in court.

Speak to your risk management, HR or the solicitor... They will be able to give you information
i was in a similar situation but was involved with our risk management team months before it went to and in the end it was settled out of court (they shouldn't have but yhst is another story!)

Thanks. This won't be settled as last time judge threw it out so our side will say same thing should happen this time. I'm hoping my boss has got it wrong and that I'm not needed. Can't starve LO for the day. Not even as if court is nearby its 50 miles from home. Can't take lo with me. Would look sweet bf in witness box lol

Is there no one that can come with you and entertain Lo at the same time? use the day as a KIT day?
 
They can cite you for court the night before - BUT - you have a very valid excuse that you can plead with the court to be excused. You must get excused and not just decided not to turn up.

I got cited while I was in hospital with Aaron who was in NICU and being BF - I told them to do one (a little more politely) and I got excused.
 
Rowesb would b too hard to keep LO entertained whole duration of court. I don't think it would b fair in him. Plus I spent 7 hours sitting round court house for this case in September and am very reluctant to do so again even if I could. Only cos plaintiff tried to make me out a liar!

I would try and speak to the solicitor yourself hun, at least then you know first hand where you stand :flower:

It might be worth phoning and speaking to the solicitor about the case,

I did this for one of my citations towards the end of my pregnancy when I was completely immobile and unable to get to the court - but my doc wouldn't give me a soul and conscience

Phoned up and said, blah blah blah, can I be excused and she told me that I wasn't needed anyway! :shock: Would have been nice for them to let me know, but either way, I didn't need to go
 
Obviously I wasn't needed cos no one contacted me again until Thursday at 5.30 wen my boss phoned again to say the silly woman had withdrawn the case from court. Someone must have told her how stupid she was to bring sprained wrist caused by fall on ice to high court lol
