Its not for me but heres the situation;

Contact order is in place, non-resident parent is due to pick the kids up on Sunday at midday. Resident parent wants to go away for the weekend so tells their father that he can pick them up from where they will be on time, or wait until the evening when they are back in their hometown.

Is this breaching the contact order?

I'm not entirely sure, but I think if a time and place for pick up and drop off is stipulated in the order, it would be a breach to change it.

I do not suspect that the contact order is a "defined" contact order which stipulates location etc. If the order was made HWCC or FPC I doubt it does but who knows what DJ or Mags may do there. For minor breaches of contact orders - there is very little that can be done - you can enforce a contact order but its lengthy and you need proof and proof should be for repetitive breach. Are the Courts still involved - of do you have a welfare officer (CAFCASS) who could negotiated maybe amendments of times to accommodate what resident mum wants so as to stop contact dad having less contact! Could some extra hours be added to the next contact or an extra overnight put in? xx PM me - or FB me lovely xx
