REALLY pis*sed off regarding incapacity benefit

i put a claim in for incapacity benefit in june, they told me straight away that i was eligable. i have sent my sick notes etc in straight away, covering me from june to october. Guess what. Today they ring me and tell me i cannot get incapacity benefit anymore as am not able to claim income support :wall: :evil: :evil: havent had any money come in since june so needed it :(
 
I don't understand that..you don't have to be able to claim income support to claim incapacity benefit they are two completely different things and are not dependant on each other..for example you wouldn't be able to claim income support if you have a partner that works..but you cannot work so should be eligible for incapacity benefit to replace your income! what are they talking about??? i swear they make these rules up as they go along.
 
I don't know all the details but I do know that they changed the entitlement to incapacity benefit at some point this year. It is becoming employment and support allowance in October so you might be able to apply again then.
If you are getting special medical treatment you should appeal:

If not, and you have to have been too ill to work for 28 weeks:

If neither of these is the case you're not entitled, I don't think.
You should apply for income support as you may be eligible because you are registered as sick.
