Ive just been given my payslip and ive been deducted for 2 days i had off sick, when i had my bleed and scare and the midwife at the hospital told me to rest. I informed my boss at the time, so can they legally do this??? Work have been nothing but a nightmare since i announced the fact!!!

No they can't do this. You are entitlement to the ordinary sick pay you get when not pregnant for any time off sick whther pregnancy related or otherwise until 36 weeks of pregnancy.

however it's up to your employer how much they pay you, the minimum by law is:

Standard weekly rate of SSP is £75.40 from 6 April 2008 to 5 April 2009. Your employer will work out a daily rate of SSP by dividing the weekly rate by the number of qualifying days in that week. For SSP purposes the week always begins with a Sunday.

Pregnancy

If you receive SSP for a pregnancy related illness at the start of or in the 4 weeks before your baby is due, SSP will stop and any entitlement to Statutory Maternity Pay (SMP) or Maternity Allowance (MA) will start automatically.

If you are entitled to SMP or MA, you cannot get SSP under any circumstances for 39 weeks starting with the day of entitlement to those payments.

If you are not entitled to SMP or MA, you cannot get SSP for a period of 18 weeks. For more information about this, please contact your employer or the HM Revenue & Customs employee helpline 0845 302 1479

Alot of employers still pay you a full days wages if you are off sick but that depends on the company. But basically you should get whatever you normally get when off sick until the 36 weeks mark.
 
Hmm are the first x amount of day not on the employee then? I read somewhere they were. Only a sick note from a GP will cover you and you have to self cert the first week iirc.
 
its counted as being off sick (like normal) when related to pregnancy up to a certain amount I think..... but its all depends on your company policy. I would check your sick policies....etc
also how long have you been with the company? last company i was with wouldnt pay you if you were off sick during your probationary period (first 3 months)
 
when you say you have been deducted for 2 days, what reason have they given? if your company dont pay sick pay then yes they can legally do this, what they cant do is use the pregnancy related absences for disciplinary purposes. to qualify for SSP i think it dosnt kick in until you have been absent for 3 consecutive days.
 
well my company doesnt pay sick pay anyway, but i thought since it was pg related they werent allowed to do this?
 
iirc you are allowed time off to attend ante natal appointments etc but sick days don't count unless certified etc.

Someone can correct me if I'm wrong, but thats how I remember it.

sorry Hennaly i dont understand what you mean about the sick days dont count
 
its down to company policy if you would usually get paid for sick then yes you should get paid.

however if they dont pay sick your not entilted to ssp unless you have more than 3 days sick then you dont get paid for the first 3 days but would for the 4th day.

Sickness due to pregnancy is not counted as sickness with your record and they cant displin you for too much sick ect.

I had 6 weeks off with hyperemesis gravidarum and they paid me full pay for the whole time I was off. It says in my employment/pregnancy info they can only convert that to maternity pay if you are off sick after you are 36 weeks. If you normally receive sick pay, then you should be entitled to it - whether or not you have a GP certificate :hug:
 
If you dont get sick pay in usual circumstances then you wont get it when its PG related either - you are only allowed time off for AN appointments, etc

SSP is only if you have 3 or more consecutive days off
