This is probly the wrong place for this question but i figured this is where i'd be more likely to find an answer, and all you guys are so friendly here.
Anyway it's a little complicated but basicly I wonderd if anyone knows anything about what the law says about working bank holidays (is boxing day a bank holiday?)
*I work in a shop and I am unfortunatly "a member of management" (i'm just a supervisor which is acctually crap) I work Monday to Friday (always have I NEVER work on a sunday) Today I was told I HAVE to work either Boxing day or christmas eve (sunday)
*I dont get paid for overtime (so I dont do it! I dont work for free)
*If i work on a bank holiday I dont get paid double time like everyone else does so generaly I dont do that either.
*The reason they need extra bodies on christmas eve is to prepare for the sale (which starts boxing day i think) But I cant acctually do anything anyway because I am pregnant and they wont let me lift anything or move anything (which preparing for sale involves doing)

Anyway I told them that I am NOT working on boxing day and i wont do Sunday either coz I have plans on both days, she said I've GOT TO!
I want to tell her to go (you know) herself.
What I want to know is can she acctually make me do it? She said she can make me work on Boxing day. And if i refuse can I be sacked for it? If not and I'll get a warning or something then thats fine I'll take a warning.
Oh yeah I hate my stinking crappy job and I cant wait to leave!! phew!

If you have NEVER worked on a sunday then I think they can't force you, if you have set days that you work, they cannot deter from those hours unless you agree!!

I used to be a restaurant manager and I had a cleaner who only worked mornings and never evenings, I couldn't make her work evenings cos she NEVER had worked evenings, so regardless of wether it said in her statement of terms that she had to work to the needs of the business or whatever, she had fixed hours and I had to rota around them....it was never a problem as I had other cleaners who couldn't work mornings, but was something I learnt about employment law.

Post this in the Working thread too, there are a couple of girls who work in HR so will be able to answer more confidently than me.

Id have said the same as Em, also while your pregnant you cant do ANY lifting rushing about etc, so what use are you in a sale preperation? (not sounding nasty just backing your point!)
Tell her no coz your not putting bubs at risk by doing stressful sale work :shakehead:

Think it depends on whether you have a flexible contract or a set one.

Wouldn't have thought they could make you if you've never done one unless it states in your contract.

Good luck with it

Plus who would work when their not getting paid?? Tell them to pay u full whack and u'll consider it

It's crap isnt it but because I'm "a member of manegement" (i quote that because that's what they say to me when they want to make me do something they know I dont want to do, any other time I'm treated like crap and not involved in any manegement stuff) but I dont get paid any overtime at all and I dont get double pay on bank holidays but am still expected to do it, I think it's a joke I aint working for free, bloody hell I dont there coz I like it I only go there coz I need the money it's ridiculous!!
I just read about if your baby is due on or after 1st April your intitled to 9 months pay instead of 6 which is fantastic and that'll really P*** them off, so I cant wait to tell them about that tommorow!!
Ha Ha and while I'm at it I'll tell them I need the 14th off coz I have a scan (that'll P*** em off too coz we're not aloud any time off till 10th January HA HA)
Sounds petty but they are really mean to me sometimes and I get pretty upset about all this stuff.

Doesnt sound petty at all hun if they use ur position to their advantage use it to yours to piss them off!
Its not fair on u hun! Try n take a pic of their faces when u tell them its 9 months not 6!! :rotfl: stick it on your fridge it will keep u happy for years! LOL
