I don't know the family of April Jones but know her godmother very well & I'm from a community close by and so many people i know from that area has at some point done something to help.

Unfortunately there are many things wrong with our justice system - however although 12 Weeks seems disproportionate to the offence I think in light of victim April Jones and the over whelming support to find her his sentence is appropriate.

Fros - I do see where you are coming from - but when was racism seen as racism and not just a joke which offended certain gendre of people? I line must be drawn somewhere, and better to draw it now than when things escalate. At this point everyone knows the consequence - will it put others off making such offensive comments - only time will tell. mwah xx
 
I think he should of gone to jail , I understand we have freedom of speech but in reality we don't as people who are homophobic and racist are punished for the views and opinions ( I don't agree with either am just making a point) if we had freedom of speech these people would be aloud to express there views with our punishment .

I think it's vile to make a joke about these poor children and hopefully by sending him to jail it may make

Social networking sites have made it easy for people to voice opinions (which should be aloud) but racism/homophobia/extremism etc needs to be addressed & dealt with when it crosses the line from stupidity to criminality and serve as a deterrent.

Luckily for him he is up in Lanacshire & not local to the family & community or he would have swiftly been lynched!

I totally disagree with jailing this immature idiot. He made a sick sick comment and deserves punishing, but NOT jail. What use is that?

Justice system is a joke!

Also, he cannot move back to his home as it is too dangerous because of the publics hatred towards him. His life has changed from his stupidity but I also don't agree with bombarding his home so that he is unsafe. He is young and made a horrible mistake, he is paying for it, leave him alone after that. Grrr his 'joke' was disgusting and soooo stupid, why he did it we will never know.

I agree with once he's done the time he shouldn't be punished further by the people around him.

However because of the time he has chosen is awful because the murder of April is so fresh in everyone's mind. People are angry at the insensitivity.

I think it depends on the circumstances of the offence and taking into account history of offending. Community service is not a deterrent for some.

I hear from my family how shocked & devastated people are around that area so it's easy for me to say that the boy should face a harsh sentence for what he's said but taking into account other instances of abuse online the process of punishment for these types of offences are now under review. It's very easy to sit behind a computer and write outrageous things and pass it off as drunken stupidity or stupidity in general but it crosses the line if that was said in person it would be treated differently again.

It needs to be consistent across forces too. It will be interesting to see how things pan out. In the meantime it's good at home that people are focused on finding April still rather than react to that muppet!
 
I agree that jail time is not appropriate in this situation. Two reasons, firstly this hasn't been to punish him, it's to make an example of him, I doubt 'rehabilitation' will even come into the equation, and I for one resent having to pay for this as a tax payer.

Secondly, we supposedly live in a free country, yet more and more often people are being hauled up in front of a judge for saying something hateful. Freedom of speech is apparently one of or most basic rights, and allegedly allows us to say the most vile, hateful abhorrent things safe in the knowledge that we are free to do so. Providing we dont act upon, or incite others to act upon these thoughts, we are safe. Except we're not, are we?

So no, I don't think he should be in Jail. I don't even think he should have been arrested.

The whole point here is what is and isnt law. There are no specific provisions in law (british) safeguarding freedom of speech. Such rights to freedom of speech as their are have been recognized as 'residual' rights. That is, British law accepts that the individual has a right to do anything that is not specifically forbidden.

Arguements can be raised about art 10 of the HR act but art 10(2) specificially recognizes that the right to freedom of expression can legitimately be curtailed where it is necessary to protect an individual's reputation.

Regardless of an individuals perception of whether the prison sentence is correct - this is something that cannot be commented upon until all facts are in the public domain. Was this person on probation, licence, tagged? sorry typ9ing quickly - apologies for typos x
 
Who knows. Whatever we all think i guess doesn't matter at the end of the day because the courts habeas decided he was to be imprisoned and must have had grounds to do so.

What i do hope is that anyone else who follows in his footsteps receives the same punishment

Yes it is all too easy to put any old crap on the internet without first thinking it through and the consequences. All too often the excuse used is people are having a laugh or a joke or whatever. People don't seem to realise this is available to the whole wide world. Most people would not dream of standing out in the street shouting and making these remarks, cos they know they probably would get locked up for it, so why do they think it is acceptable to do it in what is also a public domain?!

As for this idiot in question, if he had a load of people turn up at his house threatening him then he has actually caused others harassment alarm or distress with his behaviour which is a crime in this country. There is probably an element that is for his own safety if this was happening.

I do agree it is laughable that other crimes do not get seemingly as tough sentences.
