Legal advice needed - If any one can help?

Bit of a long post, I’ll try and keep it short.

Basically DH was in a band a while ago (they split about a year ago). Before they split up they recorded an album together. One of the band members is trying to sell the cd on his website and said that the band are signed to his record label (which my DH didn’t sign). He’s selling the cd at £6.99 and said to DH that he can buy some off him and sell them for more and make some money. DH is really upset as this guy will make profit of what my DH buys as well as ones he sells on his own and it wont be slit evenly with all the x-band members. Also this guy has put the singles on for free download!!

The guy emaild my DH and asked wether he liked the art work which my DH said NO and that he didn’t want this to be released. The guy just printed them anyway. He knows my Dh should have a say in this as his name is on the CD but he’s not listening to his opinions and has cut my DH off all the photos on the website and CD covers.

To make funds for a recording studio they borrowed money off my father in law, which one band member didn’t pay back, so my father in law owns some of the copyright to the cd. He isnt bothered about getting the money or any of this trouble we’ve been having but wrote letters stating that he is going to sue for breech of copyright but that didn’t resolve the situation.

I was just wondering what we can do to stop the sale of cd and how do we resolve the situation? As far as my DH is concerned all he wants is to forget all about the band. The problem is we dont have enought money to sort anything out :shock:

Does any one know anything about what action can be taken?
 
If he's selling a CD your other half is part of (i.e. as a band member, producer etc) and it's going to make money you are entitled by law to proffit from that - equal shares to all involved. I'd seek professional legal advise if I were you. Any payments etc this guy makes between now and the case "being settled" you will be entitled to back payments etc. I'm sure the CAB (Citizens Advice) will be able to point you in the right direction with regards legal aid if you needed financial assistance in proceeding with a case.
