If a company is paying you more than they have to (if you've worked for the qualifying periods then you're entitled to 90% of your wages for 6 weeks, £108 odd for 20 weeks then an additional 26 weeks at £0) then you have to pay the difference back if it's in your contract. If all you have received is Statutory Maternity Pay for the first 6 weeks then Maternity Allowance for 20 weeks you don't have to pay any of it back if you don't return to work.
 
In my work you have to return for 3 months if you don;t want to pay it back
 
i am in the same position. i read my maternity contract that i have to return for 3 months else i have to pay what i am not entitled to back. so i go back to work, get a new job, hand my resignation in and think that i will have to pay back 2/3 as i will have worked 2 months BUT not the case, have to pay the whole bloody lot back £2666. but my new employees have said i can start later. but i am taking 2 weeks annual leave from my old job so my last working day is 15 sep, but actually i leave on the 3 octo. but i will be starting my new job on the18 sep, but i know i can get in trouble but i dont know how much. never mind
