Estate Agents - Grrrr

Have had some great news today - we got told we're having a little boy at our 20 week scan - but now some not so great news. Had our heart set on a perfect flat, have paid a holding deposit and just awaiting references to go through and the estate agent has just said there may be a problem - the current tenant may need to stay on for 2 more months (too late for us and f** that, 2 months may drag into 2.5, 3 etc)!

Surely if he's handed his notice in he has to go?? We wouldn't expect our landlord to let us stay on when our flat had already gone on the market......???

Im slightly confused you want to buy the flat not rent it?

If your buying it then the current owner would be mad to risk losing his buyer because of his tenant. I would stress how unhappy you are, if he thinks he might lose you as buyers im sure he would get his tenants out. Also could it be possible that they havent really given their tenant notice until now and cant evict them until the notice is up.

Noo, we're just renting so they don't really care, tenants are 10 a penny round here...but I don't understand how the current tenant can get away with saying he wants to stay on when he must have handed in his notice as per the terms of his contract - otherwise they wouldn't have put it on the market, surely....

The landlord has to give him 2months notice on a 6month contract....he could just be squatting so he can be declared as homeless?
