If something is delivered to you damaged in transit can you log a dispute?

We bought a mamas and papas pramette and when it arrived today it was perfect except that it had obviously been dropped in transit and both the handles have snapped off!!! It was delivered by parcels2go and they say their contract is with the seller - she is not responding to my emails :(

Thanks for any help.

you would need to take it up with the courier.

We have spoken to them - they say their contract is with the lady who booked the delivery and she wont respond to our emails - I have send nice ones stating that we are sure it was damaged in transit but they will only deal with a claim from her - I am just a bit worried as she was quick to answer questions when we were bidding and today no response at all.....

We are 100% it was not her fault - Dave thinks it must have been dropped very hard onto the top of the box but we need her to lodge the complaint.

They are right. File as item significantly not as described with ebay and PayPal which will probably give the seller a kick up the bum to do something. You will probably be asked to send the item back via courier at your own expense but don't do so until instructed. Make sure you take some photos of the damage just in case.

Thanks ladies,

She still hasnt responded and we have sent photos to her email address as supplied by ebay. I have opened a dispute with paypal this morning - didnt really want to but as she is not replying to us I felt I had no choice......

I am sure that the pram was damaged in transit and therefore the courier will be liable for the costs but unless she lodges a complaint with them there is nothing we can do.. I only bought a pram off ebay as funds are tight at the moment and now it looks as if we could be £103 down and still no pram :(

Fingers crossed you get some resolution hun. Don't be tempted to close the dispute though, follow it to the letter!
