Hi I'm not sure if anyone knows the answer to this but I'm hoping

Before my maternity leave this April I worked full time. I used nearly all of this years holiday before my maternity leave but I know I have about 5 days left which I know gets carried over to the following year.

I'm in talks about going back part time, just two days, mainly as I've realised I like buying clothes lol anyway the holiday that I earned, will I still keep? I know if I got back two days I'll get the equivalent 4 weeks I would get full time but do I still get those extra 5 days (which technically would be 2.5 weeks) or can my boss shorten it to one week?

Does this make sense?

You get it on the basis that you earned it. So if you were full time when you earned it, you get the full amount.

Also you're still full time until you return from mat leave. So your holiday entitlement will be based on full time working until you go back. Eg I'm going back in two weeks after being off for six months. I've accrued six months worth of full time holidays and then will accure holidays on a part time basis once I go back. So I'll have three quarters of a year's worth of holidays rather than half. Same goes with any bank holidays accrued.

It depends when your part time contract starts. The 5 days are yours but if you change your contract and then take your holidays at the end of mat leave your holidays will go further eg 2.5 weeks and you'll be paid your part time wage. If your contract starts after you take the holidays you'll be paid your full time wage for the period of your holidays and then your part time salary will kick in. Usually holidays are taken under the contract they were accrued eg take the 5 days and get paid full time however you can agree otherwise with your employer xx

I had a similar situ although my new place was within the company so basically my file was sent over and it carried on as normal. I used to work 5 days a week half days, so we worked in days a day was a day to me. I moved up to full time and my annual leave was recalculated and pro ratad.

But yes, you still get the annual leave that you accrue, or you should.

xxxx
