Wandering if anyone could offer some advice please?
We are currently living in workplace accommodation which is part of my wifes job, she is pregnant and has not yet given a leaving date to go on maternity leave but her boss has already advertised and offered someone her job (not as maternity cover but as full time) and this includes the accommodation we are currently living in so we are being asked to leave in 8 weeks so this new person can move in.
Can anyone advise our position on this, she has never mentioned that she wont be returning after her maternity leave and as the accomodation is part of her job (and makes up for her poor wages) surely she would be entitled to move back in when she returns or are we entitled to stay living there whilst on maternity? any advice would be greatly appreciated.

This is causing my wife and I a great deal of stress.

Thanks for reading

Mac

Erm I don't think they can do that! I'm not 100% on the exact details - bit maternity leave is split, 26 weeks are ordinary maternity leave, and the second half is additional maternity leave. I am almost certain that you are entitled by law to everything for that ordinary mat leave - i.e. the first 6 months. I know this would defo mean company car, and company mobile (I had them), so I am almost certain a house would also be included if it is one of the conditions of her employment!

How far on is she? Is she still going to be working in 8 weeks? What a terrible thing to have to go through! There's a company called ACAS and it might be worth contacting them, or Citizens Advice!

Quite far down, under non cash payments and contractual benefits, it states there that they must continue during statutory mat leave - I'm not sure if this is the full 52 weeks, but it should be! It refers to cars, vouchers etc, so surely a house would also be included as it is non cash?

PS - this is the government website, therefore the law!

That's Great, thanks for that:) Ive been looking for ages and hadn't found anything in black and white, Ive just sent it to my wife. If they do insist on us leaving I will ask them to put it in writing and then leave and go straight to a solicitor. They are now talking about my wife coming in to work whilst on maternity leave to train up her replacement!!! Thanks again for that, will let you know how we get on :)

It really amazes me how clueless some employers are about maternity rights!
