I have been in my job about 5 months now and am hoping to stay there aslong as poss before leaveing, but im worried i wont be entitled to maternity leave due to not being there very long. I dont wana discuss this with my boss yet as shes being a bit snappy atm and cant cope with her hving a dig at me if im honest, one lass walked out of work last night, ny help woukld be ace x

I got pregnant 1 month after starting my new job. I didn't find out til i was 12 weeks, and told them at 15 weeks. I was on a 6 month probation so thought i'd give them the opportunity to fire me. They were brilliant and i get mat pay now. You don't need to tell them til the 15th week before your EDD.
Not sure how long you need to be there but i get it so can't be very long.

Hi ya,

You've got to be there for 26 weeks or more by the 15th week before your EDD, otherwise you will only be entitled to MA. I missed this by 2 weeks.Hope this helps.

As Lisa said. So basically so long as you were there before falling pregnant, you are entitled to leave and mat pay.

I was 14weeks when i started work  didnt know! I ended up with M.A You should be fine though I would have thought. Is there a head office you can ring to your side stepping your ratty boss lol

You are entitled to 52 weeks maternity leave. Many companies pay more than the basic maternity pay but SMP is 90% of your earnings for the first 6 weeks then £117.18 for the next 33 weeks. The last 13 weeks of maternity leave are unpaid. If 90% of your earnings is less than £117.18 then you get the lower of the 2 amounts. As the others have said, you are entitled to this as you have worked for the company for long enough. If you decide not to return at the end of your maternity leave you do not have to repay SMP - your employer claims the money from the government regardless of whether you come back.

You decide when your maternity leave starts (after 29 weeks). The only exception to this is if you are signed off sick then from 36 weeks they can put you on maternity leave instead of sick leave. You decide when you return to work if you wish to return before the year is up. You have to inform work about when you will leave and when you will return but they cannot tell you to leave or come back at a particular time.
