I CANT BELIEVE IT.
ive been on the sick from work since 22/7/07 due to complications in my pregnancy and i had loads of trouble gettin sick pay from my nasty emplyer and now today i get my P45 with no explanation of the reason they are finishing me and he has put on it that my leaving date was 22/7/07. is this legal?
 
your best bet is to take the letter along to your local solicitors and get a free half hour sitting and ask them.

I doubt it legal. But you're better off asking someone who knows whats what.


don't go to the citzens advice. they are crap.
 
that sounds well and truly like unfair dismissal. Go here www.acas.org.uk they will be able to advise you how to proceed.

Please don't quote me on this but I thought that employers can suggest early maternity leave, not give pregnant women who have sickness the sack!!!

Sounds very wrong to me. Let us know how you get on hun.
 
Thats is so wrong, you can't be sacked whilst on the sick anyway i think!!

you can be sacked whilst on the sick - but pregnancy related sickness is completly different - as is backdating your dismissal. :roll:

Go and get advice - and then get whatever you can out of them :twisted:
 
Pregnancy related dismissal is automatically unfair - it's protected by law.

They can still sack you whilst pregnant, but they have to prove that it was in no way at all related to the pregnancy - and if you took it to Tribunal the onus would be on them to prove it!!

There are usually solicitors who offer a 30 minute free advice session, I'd find one and go visit!
 
ok silly question, but did they know your pregnant, once i went off work sick and was off a long time and they just sent me my p45 so i rang up and they said they just didnt think i wanted the job any more :?

but if they knew u were pregnant then yes u can take them to a tribunial, i know some one that this happened to and her employer had to pay her £5k :cheer:

You can take them to the cleaners, they cannot do that to you, no matter how long you have been there? You need some advice pronto!!
 
totally agree that thy are not able to sack you due to pregnancy.

I did read on one website recently though that you should put it in writing that you are pregnant. An employer is not obliged to give you time off etc until they have formal notification you are pregnant.

Not sure if this would also cover your scenario.

Can i also suggest the DTI you could threaten to take them to an employment tribunal!!

What line of work is it??

Hi, I took my old employer to a tribunal when the same thing happened to me when I fell pregnant for jack, I won my case and was awarded over £14,000. L have not received any payment yet and it is now 16,000 due to interest, and I'm still fighting to get the money, but its the principle - they cant do that if its pregnancy related and they know you are pregnant.
