Basically whilst I'm laying here in bed I was thinking about Jacobs last name currently he has my surname! In the future if I get married I'd like him to take on my surname obviously. Just wondered out of curiosity basically would I need his fathers permission even though he's not on the birth certificate - lol! I do think of random things

In theory, yes you can as he is not considered to have parental responsibility. According to this site he may be able to stop you from changing it if he wanted to (see 'Important legal issues' about half way down)

I think if he's not on the birth certificate there's not much he can do! Does he currently have tour surname? If so I can't see how it would be a problem! He could always just use your name as a preferred name so at school and everything he goes by that! That's what I'm doing with #1!

If he's got your surname I can't see his dad objecting iykwim. Plus he's not on the birth certificate so he hasn't got a leg to stand on really xx
