well.. i have a 15months old daughter, who has lived with me and my parents from the day she was born, along with my younger brothers and sisters(all my LO's playfriends).She hasnt seen her father since she was 2weeks old.not because i wont allow him its because hes just a complete arse, who doesnt care in the slightest for my little girl. ive tried for her sake but now given up on him. HOwever he is an argumentative pig and would do anythin to cause me hassle.. dead or alive!!

which brings me to the real reaon for this post!

i had a dream that i passed away while my princess was stil very very young, and after her father found out he took her away... taking her from everything shes ever known, grandparents and aunties and uncle. x

so now i wonder if there is anythin you can do? any form of will? just in which i can forward my views on my daughters custody after i die.. like i said, she has never seen her dad and wouldnt hav a clue who he was, but i kno how spiteful he can now be.. and the thought is unbearable.

so i just wondered if any of you have either been or goin through the same thing and if so, have you any advice on wat to do or how to go about it? my hv has suggested ringing the citizens advice service, which i will. but would appreciate your advice and help x

Im sure writing a will out stating your wishes should sort that,. I dont think they are overly expensiv3e either.

Is he on the birth certificate?

If he is then he will have parental responsibility automatically (since 2003 law change) no matter whether or not he uses that right now, if you were to die, he would if he wanted to, have parental rights over your daughter. However if your family kicked up a fuss if the worst was to happen and he swanned in to try and take her i'm not sure what would practically happen, i guess social services would get involved to decide short term care and then long term care, but legally he would have some rights.

If he is not on the birth cerificate, it's different (i assume you are not married?). Then he actually doesn't have any rights and the parental responsibility passes to your next of kin. He could file to the courts at any time for parental responsibility, again i don't know the legal process of this and how often dads with no involvement have this granted, i wouldn't think too likely?

I think making a statement in your will is sensible to do whatever the situation as its a legal document that could be used in any court procedings. Contact a solicitor, there may be something else legally you can do outside of your will but i've never enquired myself so dont know!
