absence while pregnant

Check on the internet about sick leave while pregnant (i dont have a link but im sure its illegal what there doing) and print it off and show them. If they dont listen to you then take it further. Dont stress over it hun, your not doing anything wrong, your entitled to time off, if the doctor signs you off its for a reason!! :hug: :hug:

Thats an official government website. Click on the link at the bottom of the paragraph "Maternity rights - a guide for...." . It's a PDF.

In there read section 2 - you are entitled to time off for midwife apps and scans without having to use your own holiday leave.

In there read section 3 - your sickness does not count towards sickness levels if it is pregnancy related sickness and you can not be discriminated against because you are pregnant.


I know you're emotional and don't feel comfortable challenging them, but you could always print that PDF off, and if you highlight the bits on sections 2 and 3, you can talk through it with your boss and show it to him. That way you aren't kicking off without reason, and you have solid evidence to back up anything you say. They can't argue with that, and if they ask where you got it, uh the department of trade and industry website. Show them the link. I'll be so angry for you if your verbal warning sticks - they are breaking the law and if they are like this now, imagine how they will be for the rest of the pregnancy.

Thanx... i'll look over that site this weekend.. My husband is a manager at his place...he seems to think because there was someone in there taking notes while this meeting was going on.. that they are trying to get rid of me..

Got it... the Sex Discrimination Act.

Scroll down on there and you'll see it covers discrimination against pregnancy.

If they had someone in their taking notes, it's probably better for you both knowing that someone else witnessed your discussion. That will help later on. If you need a meeting with him again - which you do - take someone in with you to take notes too otherwise it's your word against his.

I'd call the CAB for you but there's no point, they are so in the wrong it's unreal. I'll be around all weekend if you need a hand just PM me :) x

Thanx Gemma... i am going to discuss it this w/e with DH and family.. see what they feel..... i am so worried about being stressed.. i don't want my blood pressure to be high ... i am on enuff tablets for it as it is.... ....
gonna take my BP tonite at home.. if its up i will be angry!!!!

:shock: I've only just read this thread....this is absolutely disgusting! What an unprofessional, ignorant and stupid boss you have. My god and you've been there 8 years?

This is not on, you absolutely have to put him straight on this. Being ill whild pregnant your employers cant' touch you......when I fell pregnant with my son I'd just left my job as a groom and then had terrible morning sickness by which time OH had said there's little point in getting another job (he's a farmer so quite happy to have ma as a stay at home mum!!) However after my sickness cleared up I became very bored and went and got a job with BT at their call centre (which I'd done as a student). They were quite happy to give me a job and made it clear that they couldn't discriminate because I was pregnant. I was there for about 3 months and did have a fair few days off in that time due to being pregnant, but each time they made it clear that it didn't count because I was pregnant, and they were very supportive of the whole thing, I was actually quite surprised!!

Anyway your boss is definitely in the wrong as everyone in this thread has pointed out, so please be confident enough to take him on. Surely there have been other pregnancies in his time as the manager?

He could get a real bollocking actually, because not only has he done this verbal warning unfairly, but you also injured yourself at work which is HIS responsibility, and if you were pregnant at the time then that just makes it even worse. Concussion is serious and you really could take this whole thing further......I can only guess that perhaps he doesn't have a bloody clue what the hell hes doing??

I would def call the citizens advice bureau or a lawyer and talk to them- they can't do that :hug:
 
As the others have been told they cannot count your sickness that's pregnancy related against you.

If you have been given a formal warning ask your manager to specify EXACTLY what absences have been taken into account and over what time span.

If the pregnancy related illness has been included then you need to put in writing an appeal against the warning and cite that a pregnancy related illness has been included, if the warning is not retracted then you can take it further as a sex discrimination case, contact the 'equal opportunities commission'

You need the warning taken off your permanent record, an apology and compensation both for the discrimination and the injury at work. CAB will point you in the right direction. Also any disciplinary (as far as I remember) you are entitiled to have some one to represent you if you wish - CAB will probably be able to recommend :hug:
 
I used to be a HR manager and dealt mainly with sick absences

You really need to clarify exactly what the warning was for before contacting anyone else, also check your companies sick leave, maternity leave rules and disciplinary procedures so you know what you are due and wether they followed the correct procedures in regard to your warning, as stated before if the warning is including your pregnancy related absence then you must put in an appeal against this.

contact the Equal ops commission as this is what they deal with and specialise in, although the CAB are excellant they deal with everything and the equal ops commission will be able to give you specialist advice.

I think exactly the same as the other girls here, you have been treated so unfairly and this is not going to help your blood pressure one little bit.

Have you thought about what you are going to do, if you want to do anything? I know it's going to make you feel awkward to do anything but you really should :hug:
 
HI all.... I haven't been able to speak to anyone about this yet.. i have been trying to get a meeting with my line manager but he hasn't been in the office this week and i found out yesterday hes on holiday for 2 weeks... i spoke to my midwife this morning as i had an appt at 10am today and was told by boss if it went past 11 i would have to book 1/2 a day off.... she told me that he can't say that... if i have any trouble with having appts for longer than 2 hrs... and he moans.. just go to her and she will write a letter stating the law that i am by law allowed as much time off for maternity appts that is necessary LOL....

Glad you spoke to your mw, she seems like a helpful lady and at least that will put a rocket up his arse if he does get a letter from her!
 
Their treatment of you is horrific. Make sure you write everything down that is being said to you. It is so upsetting that this could affect your health and raise your BP. I dont think you should let it annoy you too much - while you are pregnant your rights are well documented and precise. So I would ignore all their nastyness, take all the time you need for apts and any time off for illness as recomended by professionals and ignore them - there is nothing they can do.

Once you have had your baby and are better able to deal with stuff I would produce the log - including warnings, remarks etc and sue them for discrimination, unfair treatment and for putting you and your babies health at risk!!
 
Your midwife sounds like a gem, you'd probably be doing good by getting a letter off her anyway, as you don't want to have to book holiday leave for your scans or future appointments, and it'd be good to take into the meeting with you.

Your boss is such a ... well I can't say it, but you know what I mean :)
