Just wanted to know if anyone could help.

I have got a new job, but i have been told by my present job that if i leave before th 2 october then i will have to pay back nearly 3 thousand in maternity payments. i have got holiday left so the last day that i would have to physically work here is on the 15 september, even though i would be still employed by the NHS until the 2 october.

Now the problem is, is that they said that i cannot work for anyone else until after the 2 october. my question being, how would they know.
 
They wouldn't? The only thing is that your P45 dates might cross over, but they wouldn't know that would they?
 
Hmmmm not sure about that one, i would phone your local job centre or something they should now the ins and outs of it.

Also maybe if you contact the headteacher of the school she might let you start later

I think it is shit you have to go back for 13 weeks or lose your maternity after you have spent it!!!

How would they get it back off you anyway and surley you would just owe them for the weeks you are not working Eg: you went back for 9 weeks so have 4 left to do so you owe them 4 weeks maternity????? :wall:
 
i wish that is all it was jo, but i was meant to return for 3 months and if i left when i wanted to it would have been only 2 months so i just presumed that i would have to pay a third back, which i was fine about, but no ,the greedy b*****ds say i have to pay all of it and the total is £2666. before tax, pension etc. then they say that they want it back in six months, and i'm like youve got no chance. i'm the only one that works and my money is crap.

I would speak to someone about it, i mean what can they do if you don't pay it all back???

Worse case scenario they take you to court and they would gat laughed at and you have to pay it back at £1 a month or summat
 
thats what i will do if the school say that they need me to start on the 4 september
 
thanks i will phone the job centre later on today. the only problem i can see is that when i get my p45 it will say that i left my job on the 2 october but when i hand that into my new employer the dates would clash.

what i have asked is that if i can start work there on the 18 Sept, but not being paid from that date. so i would in fact be paid from 3 october, and hopefully they will back date it.
 
my mum was an sen and got pensioned off due to her back,if she went back to the nhs as a recpetionist she would lose her pension :evil:
 
I would suggest you ring / go to your local Citizens Advice and get them to have a look at your contract of employment.

I'm sure that as you've already worked part of the 13 weeks they can't make you pay it all back. Even to a court of law that would seem unfair.

I don't know what else to suggest.
