Paternity and leaving current job

So my partner has just been offered a new job which we are extremely happy about... only problem is I'm due in 2 weeks!!!

So basically we aren't sure how paternity leave and notice work together - has anyone had any experience with this? He's going to speak to HR tomorrow but just wanted to know roughly where we may stand as don't want him being made to work extra or move paternity if he legally shouldn't have to.

His notice is 4 weeks, so if he hands it in now and the baby is born in 2 weeks, he could technically only be working 2 weeks then finishing for paternity and starting new job after!

I've had a look on the internet but there's not much on it! Thanks for any advice in advance xxx
 
I don't know the answer, sorry. Could he speak to his new boss about it and see what they say? X
 
He can put notice in now, paternity cant be taken until baby is born though
I'd say 6 weeks and that way if he has any leave left he can whack it on at the end if you go on time. If not he can ask to be paid it if you go over x
 
I think the first thing to find out from the current employer is whether the paternity leave can be applied during the notice period. It would be also worth asking the new employer whether they would allow him to take the paternity leave even tho he is only just starting a job (he could negotiate that as part of his contract). Hope it works out for you guys x
 
I am not too sure about notice and paternity, but my OH was made redundant this year, he would have been in new job 4 months when baby is due and he has spoken to HR about it and has to take 2 weeks holiday, luckily paid. Try not to worry, hopefully HR will advise what is best x
 
We are in the same boat except my hubby's starting new job 2 weeks before I'm due so I haven't got a clue if he will be entitled to paternity in his new job! Talk about timing. Sorry I have no advice just wanted to sympathise! Xx
 
If he starts a new job, he won't be entitled to paternity leave - men have to be in a job by the time you are 14 weeks pg before they can qualify for paternity pay. You can get dependancy leave but that is max 2 weeks, has to be given in advance (I think, not 100% sure on that bit) and is unpaid. No advice on what to do but that's the employment law as given to me by Acas :)


 
Thanks for all the advice ladies! Think we are tempted to do it where he just waits 2 weeks then hands his notice in - that way he will defo do his paternity with current job and I think I'm right in saying they have to give him he paternity regardless as to whether he is on notice or not. The new company are quite good anyway and know that technically they don't have to give any paternity and are happy to wait the extra 2 weeks if need be. Will let you know what happens anyway for those who are interested and what HR say. Xxxx
