Hi can anyone help me
I work part time 16 hours 4 days a aweek.
Last week i worked 1 day and had 3 days hol to total my 16 hours but my
area manager has told my mgr to book down 5 days hol so this would put me above the 16 hours.
I said thsi wasnt right as 2 days are my days off and its using my hols up which i think is the reason for this and i wasnt told about this before my hols.
I know companies can tell you when to have time off but surely they cant say youre having extra hols booked that week to use your hols up and for you to go over your hours.
 
Holidays can only be counted against days that you are actually supposed to be at work.
i.e. if you work mon tues weds thurs and you take thurs off - its only 1 day holiday even though you are not working friday - as friday is not usually a day you work

they can't just change the terms of your employment without prior notification, so even if the holiday legislation has changed, you would have to be informed of the changes they want to make to your existing holiday policy and be given the chance to query it.
Even if you don't have a written contract stating the holiday policy, if it has been "accepted practice" then it is still legally binding.

I hope that makes sense! my preggo brain makes it hard to string sentences together :roll:
 
As the others said.

I'd definately query it and ask for a copy of the new legislation they are going by. Then look it up on the DTI website or something.

It doesn't sound right at all to be honest, if you take holiday off and it adds up to your hours, there is no reason for them to take extra holiday off to go over your hours which you wouldn't be there for anyway...

They're either trying to doddle you out of holiday, or they haven't got a clue what they're talking about. Either way, they are wrong.
