THERE MAKING ME REDUNDANT---DO I HAVE ACASE--ADVICE PLEASE

Hi Folks

I was called into my employer’s office on Monday and told my job was at risk.

I have 1 month to find suitable internal/external employment or I will be made redundant on 7th Feb.

This after 5 years + service for Compuatcenter (IT reseller)

They have told me that my role will be shared with 2 people

Person 1 is already employed by the company

Person 2 will be recruited internally/externally.

I was told I could apply for the Person 2 role, but this is a sales manager role and there is no way I will get this job.

I think it is very suspicious.

I spoke to one solicitor who didn’t seem interested and they said I haven’t got a case.

It’s the proving that they are deliberately picking on me because I’m pregnant.

Does anyone have any good advice?

Were you made aware of a possible redundancy before you told them you were pregnant? as redundancy are usually announced quite a few months before they happen. If not i would say you have a case but check with a few more solicitors or a union rep.
 
Hi

No this was a bolt from the blue, no news, no hint.

As I say they were thinking of a new role , no hint was given that I was at risk.


Im very down about this , didnt need this to happen to me , Ive worked very hard for them , and well this I believe is discrimination

That's just the type of news you dont need eh.

You need to consult a specialist in this type of thing, I used to work in HR but afraid didnt deal with this, the CAB may be able to advise or a solicitor that specialises in employment law.

I found these web sites but dont know if they'll help.

Wotever you do dont just accept it even though it's the last thing you need at moment.

Thanks for the post.

Its actually her husband that posted this , as I believe my wife has given up the chase and she was only told yesterday.

The reason is that she spoke to a lawyer today , ok this employment lawyer didn't seem interested, but shes says the difficult thing is proving anything. They are doing everything as they should, to prove that she was selected because she was pregnant.


She was in /out of the Solicitors in 20 minutes, very down in the dumps.


So I'm going to try 2 other solicitors ,and if they all say the same , well I guess there will be nothing we can do !

That aside , were delighted, baby is due 15th June. I will try and not let this take away from our happy days to come , just difficult for her, I'm trying to be strong , but it must be very difficult to be told something like this , when your body and mind is going through turmoil all be it happy.

has she confronted them, if she told them she feels she beening discriminated against they might poop their pants and change their mind???
 
I thought if they made some on redundant they couldnt avertise for a replacement or 2nd person for 6months.

I'd speak to the C.A.B, hope you get it sorted.

Congratulations on your baby. So sorry you're having this stress though.

What is your job Suzanne and what is Person 1's job? If they are splitting your role into two sections, then shouldn't you be equally considered for person 1's job as well? It strikes me that they have two positions available and two people internally who can fill the positions - I'm sure I'm seeing this too simplistically but it doesn't seem to be a redundancy situation at all.

I agree you need specialist legal advice here though. The problem is financing it up front :( .

DOnt knwif this will help but if you are with the RAC breakdown they sometimes have legal advice on their helpline along with the memebership.
 
I don't know how they can be making you redundant when they are keeping the role (albeit in two halves).

How long have you been working at the company? Do they have a written grievance procedure? I think you need to make it known you are unhappy with the decision and see if you can appeal internally before going outside to the legal profession (who may charge you a fortune with no guarantees of success).

Alternatively why not ask to be considered for either one of the two roles. There's nothing to say you can't do a managerial job if they give you a little training... and the shorter hours may suit you after the baby is born.

Please don't give up. You have rights and you need to show them you aren't a walkover.

I had a similar thing happen to me but I was able to prove it was because I was pregnant as I was able to get hold of email evidence.

If the company are generally re-organising and are doing this to a number of positions then it sounds like there could be no case here, but if it is just her job then maybe. Also they should try to find her another suitable position before actually making her redundant.

Not sure if that helps but good luck with things.
