OH made to resign - what are we entitled to??

Sorry to hear about your OH resignation.

I work for the SSA so I have a bit of an idea.
If your OH is looking for another job, he will need to claim Job Seeker's Allowance for him and you.
The only problem with that is there is usually a suspension period if you left your job voluntarily but if the previous employer confirms the situation, I don't imagine this will apply.

You will be entitled to extra tax credits for your little one and your OH will be entitled to the same free prescriptions etc that you currently are.

Also, if he is in receipt of JSA, full housing benefit will apply or full help with rates.

If he resigned, not much straight away iirc.

Saying they would sack him with no reference seems dodgy. I'd have thought that would happen for gross misconduct or some such but not because he was last in, first out. That surely should be redundancy or something else. Reference wise its a case of you never write a bad reference, just don't write one at all. If he left and needed a reference and they gave him one it would only be a good one.

If that was the offer he was tabled I'd say that was bang out of order and he should not have taken it either way. If they no longer had a job for him they should have made him redundant then he could have claimed something from the off. By resigning he cannot claim anything for a while and then Job seekers allowance, maybe some other things then too. Not sure how much you can claim for other things but he can find out at the job centre I am sure.

The reference part stinks though. Either a good reference if any future potential employer contacts them or no reference at all, which speaks volumes and is considered a bad ref. A good employee should never be told he'll not get a good reference in the future or have it used against him in such a way. Well dodgy.
 
Surely that must be illegal? He's been threatened into resigning. Maybe it would be worth contacting citizens advice or getting some other form of legal advice. I've no idea what you'd be entitled to but I would say it's worth a try.
 
it used to be if you left a job you wernt entitled to dole money for 26 weeks iirc.

what sort of company was he working for and how long did he work there for?
something sounds amiss.
You cant threaten people with no reference.
 
Hate to say it but it sounds like they just didnt like him working there,and there was no reason to make him jobless.
as there was no mention of redundancy then why else would they want him to go?

It's a shame he's accepted anything because he should have demanded the reason why he was made to make a choice and if they couldnt provide a valid reason then he could have taken it to a tribunal.
They cant just sack someone without first giving written warnings or it would have to be gross msiconduct.

it's probably all too late now as he's made the deal.
 
if he resigned nothing for 26 weeks my neice resigned due to being bullied at work and on advice from the doctor and the ss didnt want to know
 
How long has he been working for them? Less than a year's service usually means that they can dismiss him without giving reasons. Maybe it's also worth asking on http://www.i-resign.com/uk/discussion/ They seem to be fairly switched on. I guess it'll be difficult to prove though, that he was forced to resign.
 
Thats really unfair unless he did something really wrong, if they just did that to him off the cuff for no reason other than they didnt need him then they are just avoiding redundancy and the pay they would have had to give him in that scenario!! if he did nothing wrong i would say have a look into unfair dismissal..they forced him into that and he didnt really have much choice if he wanted a reference..but effectively they have just sacked him for no good reason...that is out of order!!

OH had only been working for the company since 3rd march this year, :? was still not on a perm contract, as they kept extending his 3month trial by another 3months and then another 3 but he still had another 5weeks on his temp contract when they took him into their office and asked him to resign.

the company is well known for making up their own rules, and another 5 workers apparently got the same treatment late last week.

so if we arent due anything for 26 weeks, is there anything atall we can claim in the meantime?

have put in for council tax rebait etc, still waiting to hear from family allowance, child tax credits.
