I havent been posting a while as my computer broke and had to have it fixed anyway, i have posted before my boyfriend is not very helpfull round the house or supportive anyway he went to his brothers house and came back next day bunch of flowers ect.. all was well this morning the police rang the bell and arrested him and surched my house ive never been more embarrassed im so confused what do i do?

GBH AND ABDUCTION!! WHAT now i know what the flowers are for guilt!
i dont know what to do i feel like crying but the tears arent coming what do i do just sit here and wait im so upset, they had his car reg and description of him and his brother it might have been his brother but why did he let this happen hes so selfish i this is not the first time he got a fine for punching a bouncer why does he do it he will go to prison ill be the one with three babies and a bf in prison!

im so embarrassed my neighbours 4 police officers surching my house hes a jerk this relationship will not be fixed ive had it now i will have to claim benefits and im gonna be on my own im so scared they took my phone by accident and now i cant phone anyone.

Oh Hannah thats awful for you, how old are your kids? i really hope they don't understand what is going on.

i don't know what else to say except be strong :hug:
 
jake is 3and a half so he kind of new i just said he will be back later but jake was crying i felt so awfull kye didnt have a clue or molly he has keys so im worried he will come back i cant have the locks changed its sunday i hope he gets kept in a while hes on the tenancy does anyone have any idea what my rights are what i can do because i dont want him back but i have a feeling he will get mad and bust his way in if i kick him out.

this is the end of the line im not having it anymore i feel sick i cant get rid of the thought of police men going through my things and jake crying its like an episode of eastenders or something.
 
I am sure if both names are on tenancy that you could get his taken off, if you are really worried that he might try to get in i would contact the police station where he is been held and ask them what is going on and tell them you don't want him back in the house, they then may bail him to another address

With regards to removing his name from the tenancy, can i get more info.....?

1. Are you both named on the tenancy?

2. If you are named alongside him on the tenancy are you named as a 'tenant' or 'permitted occupier'? (The difference being that the permitted occupier has no legal rights or obligations with respect to the tenancy agreeement)

3. Are you renting through your local council or are you private tenants renting through a private landlord or agent?
 
Briefly,

PRIVATE TENANT

It is my understanding that if you are private tenants and you are not named on the tenancy (and not married so not legally classed as tenant named or not) you have little to no rights to the property, and if your OH doesn't come back the landlord can ask you to leave.

He is presumably not going to really want to walk away from the property, and you can't as a private tenant simply 'remove' his name, this is to protect all tenancies, this principal may work under some circumstances but will not solve everyones problems, especially if the person to be removed doesn't want to be removed.

If you are named on joint tenancy, through private LL or Agent you can serve notice (you don't need him to serve notice too) to end the tenancy (one months notice unless you're on fixed term that hasn't yet expired/ rolled) and move to a new property on your own (without adding him to new tenancy) but I don;t know if this is really an option.

If he is happy to walk away from the property, ask him to provide notice to the agent/LL, and speak to the agent/ LL about this and taking over the tenancy solely at the end of his notice period. If you don't get this agreed, and he serves notice, the notice is deemed to be served for the whole tenancy (even of from 1 tenant) and you will have to leave.

You may be able to apply for a transfer of the tenancy under 'The Children Act 1989' for the benefit of the child(ren) - ask your LL or agent for specifc advice for your situation.

COUNCIL TENANT

If you are a council tenant, and you are on a joint tenancy, you may be able to apply for a transfer of the tenancy under 'The Children Act 1989' for the benefit of the child(ren) - speak to your local council about your specific situation.
