Holiday entitlement

Hi All,

Just a quick question to see if i have this correct. Now my holiday at work runs from jan to jan and i get 25 days. I go on maternity leave in november and am planning on staying off for 9 months (until my SMP runs out) I would then like to go back around July/august part time. Do i get my holiday based on a full time position up until august and then the rest pro-rated or will it all be pro rated from jan? Ive been very open with them and said i will probably come back part time only.

Until you actually go part time your employee contract shows you are a full time employee and therefor you holiday should accrue based on full time allowance.

I took this from the working famillies guidance

Accrual of holiday during OML & AML
Holiday accrues as normal under the contract during the 26 weeks of ordinary maternity leave. During additional maternity leave the employee will accrue holiday under the Working Time Regulations. This entitles all employees to 20 days holiday per year. You may find it easier to allow the employee to continue accruing holidays as laid down in her contract rather than attempting to administer two systems.
 
You should accrue your full entitlement because your Mat pay will be based on working full time.
