Help
I came back to work on the 9th august 2010 from maternity leave and I have just found out that I am pregnant again (15 weeks) . I have not told my boss yet as I am worry that they will sack me. what is my legal position. Plus I'm worried that I'm starting to get a bump.

Please help !!!!:(

As far as I am aware it is against the law to fire someone for being pregnant.

They definitely do not have any right to sack you because you are pregnant!! Unless your contract specifically says (which is highly unlikely) that you are not allowed to get pregnant twice in a row then you definitely do not have to worry about that... Still the normal rules apply just like they did when you first got pregnant. You can always talk to CAB or your HR department but they would have to be pretty stupid to sack you now as it would be pretty obvious why they had done and no company really wants to be accused of discrimination (especially pregnant women etc). Good luck!x

Hi,my sister had 2 children exactly a year apart,so she fell pg wen her eldest was 3 months old. She returned to work in between and was still entitled to full maternity leave, pay etc etc they can't sack u for it xx

thanks both, I'm just so stress can't believe this is happening I dreading having to tell my boss

Try not to stress too much (easier said than done, I know) but they do not have any rights to sack you because of this, you can have 4 kids in a row if you want, it is your decision! x

They definitely can't sack/discipline you in any way! If they do, get straight onto Citizens advice Bureau.

A girl at my work announced she was pregnant for a second time on the day she returned from maternity leave, she was supposed to be back for a few months before starting her second maternity leave but she got sighned off sick until her leave started. The boss wasnt happy but what could he do! She will still be entitled to her job when she returns.

Your boss may not be happy but legally i dont think they can do anything about it!

as long as you tell them in the right time frames, you will be entitled to maternity again,

good luck telling ur boss,

xxx

Hi Llanelli, I am a solicitor and specialised in employment law for several years. The ladies above are spot on - your employer can't sack you because you're pregnant again - to do so would amount to direct discrimination. However, whilst you will be entitled to statutory maternity leave/pay, depending on the terms of your employment contract, you may not be entitled to any enhanced benefits under your employment contract (a lot of employers require employees to return to work for a certain period before becoming entitled to any enhanced leave/pay). Hope this helps x

I was talking to one of my work mates and she said her friend was in the same position.... as long as you are back working before the maternity restarts you are fine! They are not legally allowed to fire you...

if you work for a big or corparate company the ladies above are spot on! however if you work for a small ie..family run business /private i am not so sure??? i believe there is some sort of loop hole (something since the reccession, this has happened at my company, making people on long term sick reduntant or somethink)???but not 100% have u re-read your contract of employment?? or do you not have 1?

Hope it goes ok when you tell your boss, it can't be helped and lots of women do it Hun

If it's anything like my work you are entitled to different levels of maternity dependant on length of service.

I know I have to return to work for at least 12 weeks to keep the enhanced part of my maternity pay, and that I have to have been working 15 weeks in that role before I hit 25 weeks prego. But in your case as you were on leave it's still classed as working so I doubt they can do anything.

Good luck
Emma x

i know how you feel hun! i went back to work when i was 18/19 weeks pregnant! i didnt tell them til i'd been back a couple of days, i was so scared! the manager i told first had actually had it happen to her o she knew just how i felt! and when everyone eventually started to twig (believe it or not some people didnt actually realise i was pregnant, managers included ) i couldnt believe how many people knew omeone who it happened to! but yea, basically, you have to go back for one shift before going back off again!!
